The purpose of these general conditions (hereinafter referred to as the "General Conditions"), together with, where applicable, the specific conditions that may be established (hereinafter referred to as the "Specific Conditions"), is to expressly regulate the conditions applicable to the contracting processes carried out by users (the "Customer") of products and/or services offered by Juan Valdez Café through its website www.es.juanvaldez.com.
These General Conditions will remain in force and valid for as long as they are accessible through the Website, without prejudice to Juan Valdez Café reserving the right to modify, without prior notice, both the General Conditions and the Specific Conditions, as well as any of the legal texts displayed on the Website. In any case, accessing the Website after such modification, inclusion, and/or replacement implies the user's acceptance of them.
The Customer is subject to the General Conditions in force at the time of contracting, and it is not possible to contract any product and/or service without prior acceptance of these General Conditions and, where applicable, the specific conditions that regulate the provision of certain services. The temporal validity of the Conditions coincides with the time of their publication until they are modified, either in whole or in part. The new Conditions will be applicable from the moment they are made available to the Customer and are fully accessible.
All purchases of Products made through the Website, after identification and authentication using the provided username and password, will be considered validly made by the Customer and binding. Therefore, the Customer will be solely responsible for any purchases of Products made through the Website by any third party who uses their username and password. The placement of orders on the Website by a minor who falsifies registration information will be understood to be carried out under the supervision and authorization of their parents, guardians, or legal representatives.
In the event of a contradiction between the terms and conditions stated in these General Conditions and the Specific Conditions, the conditions agreed upon in the latter instrument will always prevail over those incompatible terms, but only with respect to the Products subject to such specific conditions.
The electronic contracting process through the website www.es.juanvaldez.com will be carried out between the "Customer" and "Juan Valdez Café," understood as the "Point of Sale" of Juan Valdez Café chosen by the Customer during the contracting process.
The "Customer" of the website will be considered as those consumers who are individuals, residents in the territory of the EU, who are of legal age (over 18 years old), and have a tax residence in the EU, or in the case of legal entities, who can adequately demonstrate their status and accept these General Conditions and, where applicable, the Specific Conditions that may apply. The purchase of Products through the Website is expressly prohibited for minors, users who do not legally reside in the EU, or users who do not meet the requirements set forth in these General Conditions or, where applicable, the Specific Conditions.
Accessing, browsing, and exploring the catalog of products and/or services published on the website www.es.juanvaldez.com is free of charge and does not require user registration. However, Customers have the option to register as users according to the following procedure.
4.1 Requirements to register as a user.
To register as a user, it is a requirement to be at least eighteen (18) years old and provide all the required information through the form provided by Juan Valdez Café on the Website, including the data identified as mandatory. The registered user acknowledges that their user account is personal and non-transferable. Both individuals and legal entities are allowed to register on the Website.
Every registered user will have an access password, which will always be personal, non-transferable, have a limited temporal validity, and must meet minimum requirements for length and security. The user will have the ability to modify or recover the password at any time by following the procedure provided on the Website. Under no circumstances will Juan Valdez Café have knowledge of the password, which will remain encrypted in the systems of Juan Valdez Café.
In light of the above, it is the user's obligation to immediately notify Juan Valdez Café of any event that may allow the misuse of their identifiers and/or passwords, such as theft, loss, or unauthorized access to them, in order to proceed with their immediate cancellation.
As long as such events are not reported, the provider will be exempt from any liability that may arise from the unauthorized use of identifiers or passwords by third parties.
4.2 Cancellation as a registered user.
The legal relationship derived from registering as a Customer on the Website has an indefinite duration. Either party may unilaterally terminate or suspend this contractual relationship at any time and without any further reason than their own will to do so, without prejudice to the obligations arising from placing orders prior to the termination of the relationship.
The Customer may unilaterally exercise the right of termination by going through the account cancellation process.
In any case, once the cancellation has been completed, the user may request a new registration, subject to the provider's discretion to deny such registration in specific cases specified in the clause titled "Website Usage Rules" or in case of a conflict or controversy between the parties that is pending resolution or has ended with the user's acknowledgment of fault or negligence and/or causing harm to the provider, its employees and associates, or its users, customers, or potential customers.
Similarly, Juan Valdez Café reserves the right to cancel the username, password, and therefore the access to the Website for users who have outstanding or unpaid balances.
5.1 Information and availability of the offered products.
All information regarding the products and/or services offered by Juan Valdez Café through its Online Channel will be published on the website www.es.juanvaldez.com, providing the following information for each of them:

In the event that the Online Channel does not have stock of any of the requested products, Juan Valdez Café, through its Online Channel, will inform the Customer of this situation and proceed to promptly refund any amounts paid for such product(s), without undue delay.
5.2 Stages of the electronic contracting procedure.
Once the user has selected the products and/or services offered by Juan Valdez Café, the user should follow the stages of the contracting process as indicated below:
Stage 1 - Validation of Shopping Cart: Once the user has finished selecting the products and/or services they wish to purchase, they need to validate their shopping cart. This step will display the selected products and/or services, the quantity, price, delivery timeframe, and shipping costs.
Stage 2 - Providing Billing and Shipping Information: After validating the shopping cart, the user must provide Juan Valdez Café with the billing and shipping details for the products and/or services. The user must explicitly accept the Contracting Conditions by checking the corresponding box. If the acceptance box is not checked, the Website will not allow the user to proceed with the contracting process.
Stage 3 - Select Payment Method: After providing the billing and, if applicable, shipping information, the user must select the desired payment method. Currently, Juan Valdez Café validates the following payment methods: Card or Bizum.
Stage 4 - Payment of the Total Amount: If the user has chosen either of the two cash payment methods (Card or Bizum), they will be automatically redirected by the system to the online payment platform (TPV) of the corresponding banking entities.
Stage 5 - Purchase Confirmation: Within a maximum of 24 hours from the moment the payment is successfully made by the customer, Juan Valdez Café will send an email to the Customer providing a summary of all the details of the purchase.
This email will be considered the "Purchase Receipt."
Furthermore, by accepting these general contracting conditions, the customer agrees to receive invoices resulting from the purchase of goods and/or services from Juan Valdez Café in electronic format. The customer can request these invoices by email at the following address: administración.email@example.com.
By confirming the purchase, the Customer declares to be aware of the allergens of each product, which are clearly displayed and stated on the website, releasing Juan Valdez Café from any liability.
6.1 Economic conditions.
All products and/or services offered on the Website are associated with the final price of the product, as well as any discounts that may be applied to the purchase. The prices displayed on the Website are applicable exclusively to the Products offered through that Channel and during the time they are published. The prices of the Products are always shown in euros and include VAT, as well as any other applicable taxes, at the current and legally applicable rates.
Similarly, all prices shown do not include any applicable shipping costs if the Customer selects the home delivery option. These costs will be identified separately before the sale is confirmed.
In the event that Juan Valdez Café identifies a manifest error in the price of any of the published Products, they will immediately inform the Customer and publish the rectification on the Website and through usual communication channels. The Customer will have the option to confirm the order at the correct price or cancel it.
Juan Valdez Café expressly reserves the right to modify prices at any time without prior notice. However, in any case, the current rates indicated on the Website at the time of placing the corresponding order will be applied.
6.2 Payment methods.
To proceed with the payment, the Customer must follow all the instructions shown in stage 3 of the electronic contracting process, as described earlier.
All payment methods provided by Juan Valdez Café are subject to verification and authorization by the issuing entities of the payment method (card issuers and/or payment account issuers). If the payment is not authorized by the issuing entity, the purchase process cannot continue, and the order will be automatically canceled, resulting in the non-completion of the sale of the requested Product(s).
The charge for the price of the Products, shipping costs (if applicable), and any applicable taxes will only be made at the time of placing the order.
To carry out the electronic payment, Juan Valdez Café has an e-commerce payment gateway provided by authorized banking entities.
All data provided to Juan Valdez Café for this purpose is properly encrypted to ensure maximum security and confidentiality. It is stored on a secure server certified according to the "Secure Socket Layer" (SSL) protocol.
Under no circumstances will Juan Valdez Café store the card details provided by Customers through the payment gateway. The details will only be retained during the purchase, payment, and the withdrawal period, in order to process any corresponding refunds.
Products purchased through Juan Valdez Café's Website will be shipped to the postal address provided in the order form. The delivery address cannot be a P.O. Box or public places such as streets, squares, stations, airports, or similar locations. In the case of home delivery, the delivery will generally take place on the date selected by the Customer at the time of purchase, unless there is a force majeure event.
Note: Orders placed on Fridays will be processed on the next business day. On public holidays (regional and national), Correos does not provide service.
Home deliveries are only available for destinations within mainland Spain, and they will be made within the time frames detailed in the following points. Juan Valdez Café cannot guarantee delivery at a specific time within that time frame.
7.1 National deliveries.
The shipping cost is 4.99€ with scheduled delivery on the next working day after acceptance.
For national shipments, the transportation responsibility lies with the logistics company, Correos Express, which will be responsible for delivering the package on the specified day, following their protocols and working methods. However, Juan Valdez Café will provide all available information to ensure smooth operation and communication with the logistics company.
If you are not available at the delivery location at the time of delivery, the logistics company will contact you by phone to arrange a second delivery attempt on the following day. If the second attempt is unsuccessful, you will be able to collect your order from a Correos Express location in your area.
The User has the right to withdraw from the purchase made through the Website. Therefore, if the User is not satisfied, they can return the Product within a maximum period of 14 calendar days from the date of acquiring possession of the product(s) or from the formalization of the contract in the case of service contracts, provided that the product has not been already prepared.
The right of withdrawal can be exercised by contacting the Customer Service, where the steps to follow will be indicated.
The return will include the amount of the purchase and, if applicable, the delivery costs. The refund will be made using the same payment method used to purchase the Product, with the return costs deducted, which will be borne by the customer.
When the purchased Product or Products do not correspond to the offered characteristics, present defects that prevent their normal use according to their nature, or fail to provide the described functionalities, the Customer has the right to have the purchased item repaired or replaced in accordance with the provisions and evidentiary means set forth in the Consolidated Text of the General Law for the Defense of Consumers and Users. This is without prejudice to the powers of the Customer Service to verify the veracity of the defects, their origin, and the time of their occurrence.
In any case, the Customer must contact or request the collection of the product from the Customer Service within a maximum period of 24 hours from the discovery of the defect, providing information about the nature of the problem and the time and conditions of its occurrence.
Furthermore, the Customer has the right to have the item repaired or replaced in accordance with the provisions of Article 118 and following of the Consolidated Text of the General Law for the Defense of Consumers and Users.
In any case, the legislation applicable to consumer goods sales warranty will be applied. If the product is defective, Juan Valdez Café will be responsible for replacing the product at no cost to the Customer whenever possible. If, due to availability reasons, the replacement of the product cannot be made, a full refund of the purchase will be issued.

It also cannot guarantee the absence of viruses or other harmful components on the Website or the server from which it is supplied.
All information provided during the contracting process will be stored by Cafescol Tiendas S.L., in its capacity as the data controller and manager of the Website, which will be responsible for the processing of Customers' personal data who have actually made the purchase.
The collected data will be made available to the transportation and logistics company responsible for delivering the purchased item through the website www.es.juanvaldez.com, as well as any other operator involved in the purchasing and/or delivery process, for the purpose of fulfilling the contract(s) with the customer and the related relationships. However, before disclosing any personal data to third parties, the Customer must expressly consent to it.
The buyer is informed that the personal data provided will be incorporated into a file owned by Juan Valdez Café, and the processing of their data is necessary for the management of the contractual relationship and the provision of services.
For the aforementioned purposes, the buyer guarantees that the provided data is accurate and expressly accepts responsibility for any consequences that may arise from the falsity of such information.
Juan Valdez Café has implemented the necessary technical and organizational measures to guarantee the confidentiality, security, and integrity of the provided personal data, as well as to prevent its alteration, loss, unauthorized access, or processing.
In order to keep personal data up to date, the buyer must inform Juan Valdez Café of any changes that occur, as otherwise, Juan Valdez Café cannot be held responsible for their accuracy. The buyer is informed that they may exercise, free of charge and at any time they deem appropriate, the rights of access, rectification, erasure, restriction of processing, objection, or portability regarding the personal data provided. They may also withdraw, at any time, previously granted consents by submitting a written request along with a copy of a valid identification document to the postal address (…) or by email to firstname.lastname@example.org
These conditions have been presented in due time, in accordance with current legislation. Additionally, Juan Valdez Café provides these Purchase Conditions so that they can be stored and reproduced, thus fulfilling the legal obligation of prior information. Juan Valdez Café reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website, its functionalities, and/or the contents incorporated therein. You expressly acknowledge and accept that Juan Valdez Café may interrupt, deactivate, and/or cancel access to and/or use of the Website at any time, without any liability on the part of Juan Valdez Café.
If any provision or provisions of these Purchase Conditions are deemed null or unenforceable, in whole or in part, by any competent court, tribunal, or administrative body, such nullity or unenforceability shall not affect the remaining provisions. In such a case, the affected clause or clauses shall be replaced by another or others that have the most similar effects to those of the replaced ones.
The parties expressly agree that this contract shall be governed by and interpreted, in all its terms and conditions, in accordance with the current Spanish legislation. The parties expressly submit, for any issues or disputes that may arise regarding the interpretation, compliance, and execution of this contract, to the jurisdiction and competence of the Courts and Tribunals corresponding to the buyer's domicile or to those of the place of performance of the contractual obligation.
Likewise, as an entity adhering to Confianza Online and in accordance with its Code of Ethics, in the event of disputes related to online contracting and advertising, data protection, and protection of minors, the user may resort to the extrajudicial dispute resolution system of Confianza Online (https://www.confianzaonline.es).
Similarly, in accordance with the provisions of Regulation (EU) 524/2013 applicable throughout the European Union, Juan Valdez Café makes available to users of the Website the following link: http://ec.europa.eu/consumers/odr/
